The terms that govern TextTea access, subscriptions, acceptable use, and dispute handling.

These Terms of Service ("Terms") govern your access to and use of the TextTea mobile application for iOS and Android and any related services we provide through the App.

TextTea is operated by Sean Patrick Gallagher ("we," "our," or "us").

By downloading, accessing, purchasing, or using TextTea, you agree to these Terms. If you do not agree, do not use the App.

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play, not directly by us. Your purchase is subject to the terms, billing rules, and refund processes of the applicable app store.

4.3 Automatic Renewal

Unless you cancel before renewal, subscriptions automatically renew for the same billing period and price then in effect through the applicable store.

4.4 Cancellation

You must manage and cancel subscriptions through the platform where you purchased them:

Deleting the App or deleting your account does not automatically cancel a subscription.

4.5 Refunds

Refunds are generally handled by the app store through which you purchased the subscription. We do not control Apple or Google refund decisions.

"User Content" means any content you upload, paste, submit, or otherwise provide through TextTea, including screenshots, text, prompts, notes, or support messages.

You retain ownership of your User Content.

You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your User Content only as needed to:

TextTea provides AI-generated interpretations and suggestions. Those outputs are for informational and entertainment purposes only.

TextTea does not provide:

The App, excluding your User Content, includes software, branding, design, copy, interfaces, and other materials owned by us or our licensors and protected by law.

These Terms do not transfer any ownership rights to you. We grant you a limited, revocable, non-transferable, non-exclusive right to use the App for its intended purpose, subject to these Terms.

9. Privacy

Your use of TextTea is also governed by our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy on a pure data-processing question, the Privacy Policy controls for that question.

10. Third-Party Services

TextTea relies on third-party services, including Apple, Google, Firebase, Adapty, and related infrastructure providers. Those services may have their own terms, policies, and technical limitations.

We are not responsible for third-party services or for failures caused by them.

You may stop using TextTea at any time.

We may suspend or terminate your access at any time if:

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO TEXTTEA WILL NOT EXCEED THE GREATER OF:

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

Before filing a formal claim, you agree to try to resolve the dispute informally by contacting PatrickGallagherEmail@gmail.com.

If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in Los Angeles County, California, except where applicable law requires otherwise.

You agree to bring claims only in your individual capacity and not as part of a class, consolidated, or representative action, to the extent permitted by law.

If you downloaded TextTea from the Apple App Store:

If you downloaded TextTea from Google Play, Google Play’s terms and policies also apply to your use of the App and billing relationship.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you in the App, by updating the posted Terms, or by other reasonable means. Continued use of TextTea after updated Terms take effect means you accept the updated Terms.
